This is the payment (mūla) of ja Padyəp who used harsh speech: the P.P.T.R. Indravarman, prince Śrī Harideva, man of Śilābandha Vijaya, gave to Y.P.K. Śrī Indravarmaśivaliṅgeśvara the family of mauk Yāṅ Karuṇā, mother of ja Dyəp, 3 people.

Commentary

Aymonier (1891) noted that the names Padyəp and Dyəp probably designate the same individual, and that mūla, normally meaning “capital, price”, must here have a meaning like “penalty”. Lepoutre (2015) commented that this brief text (which may usefully be compared with C. 53) seems to reflect an instance of a convicted criminal paying his penalty by his family members being put under debt bondage. The crime seems to have been that called vākpāruṣya “verbal assault” in Hindu law.

Parmi les inscriptions cam, seule l’inscription de Po Nagar C. 29 témoigne d’une telle pratique : elle enregistre l’engagement de trois personnes au service du temple à la suite de propos inconvenants tenus par l’un des membres de leur lignage.

Si la nature du délit est ici claire 104, la liste de l’inscription C. 213 ne mentionne qu’un seul cas d’accaparement de domaine, celui d’un temple pillé (A.24-B.2). La première partie de cette liste (face A de la ligne 1 à 23), indique simplement que les fautifs sont des « insoumis à Panrāṅ », une formulation que le manque de détails fournis ne permet pas de préciser, mais qui tend néanmoins à conforter l’hypothèse du rôle prépondérant de ce pays, et donc celui du Pāṇḍuraṅga, sous le règne de Jaya Parameśvaravarman. Les fautes commises par les « gens de Harāṁ » (B.2-B.3), par les « gens de Panrāṅ » (B.3-B.14) et

par Pvaḥ Jūk (B.14-B.17) ne sont pas précisées, mais ce dernier, tout comme les gens de Panrāṅ, est désigné comme étant « insoumis ».

On ne connaît donc pas la nature précise de la majorité des délits mais il semble que ceux-ci n’étaient pas toujours de même gravité et qu’il y avait différents degrés d’implication des insoumis, puisque le nombre d’engagés au sein de la parentèle de chaque insoumis varie considérablement : certaines des amendes non payées par les fautifs ont ainsi mené à l’engagement de quarante fois plus de personnes que d’autres. On remarque que l’accaparement du domaine d’un temple par Hari Dyam̃p a conduit à l’engagement de trois personnes, soit la même peine que ce qui fut infligé sous Jaya Indravarman pour avoir parlé de façon irréfléchie (C. 29). Ceci laisse imaginer la gravité de la faute commise par ja Putiḥ (A.15-A.17), qui mena à l’engagement de quatre-vingts membres de sa parentèle. Notons cependant que certains facteurs tels que l’âge et le sexe des serviteurs, qui devaient entrer en ligne de compte dans la valeur qu’on leur attribuait, ne sont pas précisés dans l’inscription.
